I have just spoken to my legal adviser and to the BBC Watchdog who confirmed that I can reclaim the money spent from UMGE regardless of their location. The BBC has also agreed to investigate this claim and wants all players affected by this (sadly only from the UK) to come forward via their webside and leave the details.
I suggest you make a screenshot of the ToS, the system message you received today and the post here on the forum stating clearly that the game is out of beta. Phone your bank and cancel all payments made to this company and be prepared to lawyer up in case UMGE think they have a counter claim to make. The UK is offering a comsumer protection scheme where they will allocate you a legal representative under legal aid. Info about that you get at the BBC Watchdog and every Citizen Advice Bureau.
I have also heard that there is a group of players planning a legal action suit against the company, but for that you need to dig yourself.
Beta Testers are either free or paid to do the job - they never, ever have to pay for the priviledge. See Sega UK for more info since they have done something similar in the past and had to shell out millions in compensations and fines and now employ an army of testers.
Needless to say is that I won't be part of this scam any longer.
