Actually it can be state mandated. FOr alot of county and state job's you have to take a drug test.

I was referring to private sector jobs. The state can mandate drug tests for jobs that require state certifications. But, the state can't force a run-of-the-mill company like a restaurant or retail store to institute drug testing as part of the hiring process.

The state can mandate drug testing for government jobs, because the state is the one doing the hiring.
