    Default Historical Heroes Rules

    Is it against the ToS to sell historical heroes for profit. Even if it is to pay for level 10 gear?

    I mean like go out and catch all the important ones before anyone else and them sell them back to people for outrageous prices. Turning Evony into nothing but a market.

    Yes, it is completely against the Terms of Service to buy/sell accounts and anything therein. (So that includes heroes, cities and everything else.)

    That's what I thought. But at the same time, will Evony even bother to do anything about it?

    I can't answer that, but I know they don't look favourably upon it. Whether they actually take action against these players, I do not know.

    Ownership/Selling of the Account or Virtual Items.
    Regan Mercantile, LLC does not recognize the transfer of Evony Accounts. You may not purchase, sell, gift or trade any Account, or offer to purchase, sell, gift or trade any Account, and any such attempt shall be null and void. Regan Mercantile, LLC owns, has licensed, or otherwise has rights to all of the content that appears in the Game. You agree that you have no right or title in or to any such content, including without limitation the virtual goods or currency appearing or originating in the Game, or any other attributes associated with the Account or stored on the Service. Regan Mercantile, LLC does not recognize any purported transfers of virtual property executed outside of the Game, or the purported sale, gift or trade in the "real world" of anything that appears or originates in the Game. Accordingly, you may not sell in-game items or currency for "real" money, or exchange those items or currency for value outside of the Game.

    Yeah that's great and all but that doesn't mean Evony will pay attention to players that are actually doing it. Oh well I'm preaching to the choir...

    While Evony's TOS ownership guide does state that players aren't suppose to sell/trade HH's it is subject to rule and can be debated in the court of law if a player is interested in going that far.

    You spend money on evony for a "product" be that a HH or armor.
    So technically in the court of law whatever you purchased with you "cents" is your property in Evony's world. I asked my friends uncle and he's a Judge and has seen these cases before. while the TOS forbid it if the player or Customer actually spend money on the game they are entitled to their "virtual" possessions in the game. they are just unable to sell it outside the virtual market (evony) as that would breach the copyright laws on the "product".

    This is also to the point of spending your money on evony for a particular item say you spent money on evony for a HH picture and it is locked in a city and was never persuaded. Because you are unable to get the HH you were unable to preform the set of tasks evony has set-up in the game for you. you would be able to contact your credit card company or PayPal whichever you use and they would issue a credit for you based on a faulty product. I personally have not done this but know of players that have.

    So in the end while Evony's TOS state that it is not a posibility to sell HH's or accounts and they do support that it may not be binding in the court of law.

    its BS if you ask me....first people spend loads of cash to rise to the top of thier server...which is fine. but they take all the HH's and this means that the heros are gone forever....unless you are willing to pay $100 for a hero. why should i pay $100 real money for something that cost $1. not only does this destroy the server somewhat but its a very bad merry-go-round.... the money "earned" by the HH sellers is then put to use on a new server where the cycle starts all over again.

    how does evony stop this though? HH's, HC's, full accounts (age1/2) are being sold and huge profits made off the back of evony. what happens to the player that gets caught also? by rights any player that gets caught doing this should have a knock on his/her door from the old boys in blue, spend the night in a cell and be presented with a court date where they face criminal procedings.

    HH are powerful, sure. But I think it's the novelty and rarity that makes them popular, important and worth selling.

    If HC were that rare, people would sell them for money.

    You see it in other games, too. Even items that bare no game-impact become worth real cash.

    It's the culture of the game, and while evony cannot moderate what they cannot see, they also cannot be blamed for that which is a product of the culture.
