    I want neither free stuff, nor an apology. Frankly I'm not even interested in a company-line explanation.

    What I want is the issue to be fixed.

    It's no longer a question of dealing with lag. It's now a question of whose day it is to be locked out while others are online running rampant through others cities. It's gone on too long to be a temporary issue, or a settling in of new software etc. Fix the problem before even your die-hard supporters are forced to quit due to a lack of ability to log on.

    You are right, but your comparison is off. The problem is you don't sign a TOS before you enter the theater to watch the movie. IF you had to sign a TOS saying that at any point the movie could be turned off with no refunds, THEN you would be spot on. Unfortunately, the TOS they use gives them the power to do literally anything they wany with very little recourse for players.

    Are we going to get a response from an official represntative? I see davemata is viewing this thread at the moment. Looks like a server roll back is out of the question as its been over a day now, which sucks so bad.

    It's just annoying how things like this happen and we are sort of shown the middle finger. I'm getting really tired of it now.

    As said its not evonys fault that the servers went down, and its not their fault that they came back up at a bad time for you and they shouldn't have to compensate anyone for this. If anything a compensation for the food bug would be more-so acceptable.

    I've noticed some complaints of lost Vestas. Please report that in the CS ticketing system and then send me the ticket number via pm.

    The type of outage this was, is unavoidable in a lot of circumstances when it happens. It not only impacted us, but our upstream connections for a longer period than we could have imagined. While unfortunate, it's not unheard of for major outages such as these to occur. We're having ongoing discussions with parties involved to see how we can better prevent something like this from occurring again in the future.

    Actually, you do "sign" a TOS when entering a theatre... Most have some type of governing language on the ticket you purchase. Now, arguably, nobody reads it, but it is there...and one could argue that, under contract law (here in the USA at least) you cannot have agreed to it because you didn't get an opportunity to read it prior to remitting payment for said ticket, thus there was no 'meeting of the minds' required for a valid contract to exist. To get around this usually there is some language on the ticket which states 'if you don't agree with these terms return ticket for a refund', or something to that extent.

    The Evony TOS has never been challenged in court; however, arguably you cannot agree to a contract which is illegal under applicable law. For example, you cannot enter into a legal agreement to kill someone, because the act of murder is illegal, thus nullifying any such contract. Likewise, taking money from someone and not providing them with the service/items they paid for would be considered 'theft' of various degrees, depending on the monetary amount involved, either a felony or misdemeaor under applicable law. It could also be considered wire fraud or mail fraid, depending on payment is remitted. Of course, you have to, once again, get the authorities with the ability to bring charges within the appropriate jurisdiction interested in pursuing such a claim.

    When you purchase game cents, Evony has an obligation to provide you with said item. Likewise if you expend the game cents for an in-game item, you have a reasonable expectation to be able to use said item and receive the appropriate value for exchanged game cents. By purchasing game cents, you're not entitled to 100% up-time, because that isn't what you paid for (although, admittedly, there is legal precident to make a saliant argument that system downtime prevents you from using the items you paid for, thus, system downtime is essentially the same as denying you access to the items for which you paid, but I believe the downtime would have to be demonstrably more significant than it has been). First and foremost, as an informed consumer, you should also protect yourself by making any online purchases using a credit-card, where your credit-card company would then become your advocate should your online purchase be less than satisfactory, or you do not receive appropriate value for your purchase.

    Obligatory Disclaimer: I am not a lawyer, although I do play one on TV, and this legal opinion is worth exactly what you paid for it in game cents.

    Dave, really appreciate you dropping in on the thread and viewing it. And that you went the extra mile and posted that the servers had issues that lasted longer than you anticipated.

    You addressed the issue with the Vestas for people, thank you.

    But nothing about the loss of food on the servers or troops while offline.

    Also, whatever the fix was that you employed it did nothing to alleviate the lag on servers, or at least SS56.

    For all that you said in your post, it is the things you don't say that are frustrating people. Give us a little break here please and tell us that you are looking into a way to fix the lag. Heck even tell us that we are getting 8 hours of free food to replace what was lost during down time. Explain to us a little about why servers lock out 90% of the users and yet people are still able to log and cap stuff?

    Pretend for a few seconds that you guys made some money off of Evony and that it might be worth a little of your time and energy to fix up a bit.

    SO to sum it up so far. Evony doesnt believe food was consumed during the outage.
    You may get a vesta if you were on vesta before the outage.

    Lets just look at it like this too much time has passed for a rollback.
    if you are all worried about the 16 on 39 dont. It was caped with a timed wave. the guy who lost it had been bot comforting for 8-9 days with no troops in it. Had he put troops in it he would not have lost it. And while I care less that he bots, Dont use the argument that your defense failed because of an outage. It failed cuz it always fails. Bot comforting will fail eventually as it has with every HC that my alliance has taken out when they use it.
    We all lost stuff in the outage
    I lost 3B food, troops that werent cued, gold, rez that was not produced etc. Reds and blues suffered. Oh well such is life.
    Evony will do nothing. Stop worrying about. Stuff happens, get over it and move on. Rebuild and keep fighting.

    Visats is not an issue I have over 16,000 hours left if that lets you know what I spent on here. My worry is now all of my cities and heros are gone when we where offline. I come back after 7-8 hours and wake up without being able to truce for sleep and have nothing. You did not set up a none attack clause so people could set there accounts back up because of the down time. My army was scattered before i got booted and stood no chance when i was gone. one million archers does nothing when in 5 cities spread out. I have nothing left after 4-5k spent is my worries and your doing nothing and no one is responding to my messages sent in. RESET THE SERVERS BACK TO THE ERROR TIME SO PEOPLE CAN START WHERE THEY LEFT OFF. We have lost the last few days anyways at the least you could get our game back to how we left it before the server crash screwed everyone over.
