BBQ isn't doing any better than Domo. He's feeding the troll with flames, turning himself into a troll, too.

Many of the moderators here have a very hard time identifying what "civil" conversation is. I think you might want to step back and reassess. Just because you have the power to do something doesn't mean we all need to be made aware of it every time there's a thread where someone disagrees with something.
As for the topic at hand - people voluntary paid for things. They are not required to play the game, nor are they required to pay to play in any way. They are PERKS.
Might as well also go to Maplestory and sue them. They had their Cash Shop up and running during BETA and they have not been banned or shut down.
All this does is remind me of the person that sued McDonald 's because they spilled coffee on themselves and the cup had no warning label saying, "Warning the contents of this beverage is hot." [Yes there is a point to this post]
Someone that wants a quick buck because they found a loophole. Once again just because something is offered to you doesn't mean you HAVE to take the offer. At the risk of sounding redundant, You will not be losing anything during this change/update or whatever it's going to be called. So therefore you really have no other strong argument other than, "You cannot spend money on BETA games period?"
Be a different story if the servers were being wiped and you lost all your progress to this point. However, you are not and with that you have no real viable case. Yes, they should've mentioned it. That's fairly obvious by the 3rd page of posting.
It's pretty pathetic that someone wants to take the easy way and sue a company over something so simple.
Frankly I thought Domo handled himself reasonably well. Is it really trolling when you have a point and the Mods are jumping all over you for expressing it?
UGME's antics here may very well be a borderline violation of software release law even if the violation is inadvertent. They wouldn't be the first software developers to get hurt that way.. I hope they aren't since this is a good game but it's close enough to worry about.
Also if UGME was doing a better job communicating with and reassuring their customers people would just enjoy the product and make informed consent on whether to spend money on it yet or not.
In order to be willing to sue for fraud you first need to feel defrauded. UGME had the ability, and the responsibility to make sure that was unlikely. They certainly could have done better at that.

Let's just say it isn't the first time people have noticed you posting in this manner.
Seriously. If you're going to ask other people to abide by the rules, you must abide by them to a greater degree as the enforcer. I really don't care whether you like him or his posting habits. You volunteered for the position, now act like you deserve it. Your posts were worse than his, even if he is wrong.
