    I still can't comprehend how they're going to sue someone for this. Asking for information from any email provider will be against their security policy. Not even all of their employees (email provider) have access to personal information.

    Unless Evony wishes to wilfully hack a company's database I can't see any loophole that allows them to access personal information.

    Then there comes the question of Internet protocol address that can br used to find a internet server provider. Yet, the internet provider will have very simliar policies for customer information. Usually personal information is secuirty classified.

    So if a moderator wants to explain the process of legal pursuit, please do so via private messaging. I'd rather not muddy this topic anymore.

    I've long accepted there's no point in arguing over this game anymore. It just gets tiresome.

    The likelyhood of a law-suit being filed against an end-user is minuscule, but against the creator of a widely used botting program, possible. Afterall, Blizzard sued MDY the maker of Glider and won. So, lawsuits over botting can be filed, just not necessarily against the end-user; the end-user would (should?) simply be banned.

    It is a good thing that irrelevant people like you aren't in a position to make any important decisions about anything.

    Likelihood of a law-suit being filed in this case is determined by the evony people - it is either 0% or 100% because it is a binary question of whether they file or not. Now likelihood for winning is a totally different story; let's just say there isn't a precedence for winning cases where a company sues its customers....

    As for the other company you mentioned, you really should look into what you are posting for relevancy before you do so. That case has no similarities; in fact the case was brought forth on commercial grounds that the defendant was infringing on the plaintiff's intellectual property for profit. In this case, the programmers have released the code 'open source' so there is no commercial grounds for infringement.

    If you had a clue you would know this and not have posted the misinformation that you did. In fact, misinformation being posted on legal matters is in fact a criminal offense in some jurisdictions itself o you may just want to find out for future reference, especially if you live in the US.

    And to cut people off at the pass, DMCA isn't enforceable outside of the US, nor is it even able to be tried in court these days since the entertainment industry has plugged up the court system for the next 12 years.

    can someone please tell me what they would sue a bot-user for ?

    The Bot player has done no damage to the server or aquired any money illegally with the use of the bot. He has done no physical damage to anyhting. Bots do not hack anything, they are just a script which does the same a human can do. The do not run at the Evony End, they run at the user-end, so no data has been compromised (at least not Evony's).

    So what exactly are they going to sue bot-users for ? Fresh Air ?

    Well you technically can file a civil claims lawsuit in many jurisdictions in the US for pretty much any reason; winning one on the otherhand is a different story.

    They could claim that they were damaged because the person wore pink pajamas while playing and that offended a group of people. Silly I know, but still possible.

    The argument they might have is excessive use of bandwidth but that went out years ago when a judge agreed that a accessing a publicly accessible internet address is no different than a mass of people standing on the sidewalk in front of a store.

    Now what they can be getting into hot water over is the threats of lawsuits against players/customers - right there US citizens should be notifying their local standards boards/FTC asking for an investigation. Unfair or harassing business tactics are usually frowned upon.

    If anyone is interested in contacting evony's hosting provider, it is m5hosting out of San Diego. They are resellers of AIS data center services (I just know because I have space there as well) so you could contact AIS with complaints as well.
