I could be wrong about this but isn't it also the case that as privateering requires Academy 10 attacks sent from a city without a L10 academy don't get the advantage? You'd be very unlikely to put a script into the academy so really only attacks from captured L10 NPCs are going to get the 30% capacity reduction.
