    I would send a Virus to Washington and make a press release blaming it on Evony

    You pay a doctor to look at your health condition, he says you're in bad shape but he'll help you out with surgery for $10000 up front and you have to agree not to smoke for 60 days. You break down and smoke, the doctor refuses then to treat you, you don't deserve your money back either? Even though you've paid for something you're not receiving?

    lol you mean that same forum that Evony are no doubt reading every day so they are aware of any impending retribution? lol

    It's pretty simple. Evony warned people about using a bot. If you still used one then you must face the consequences. Spending money on the game does not entitle a person to special treatment. If you used a bot, then you knew the risks so people need to stop whining and just get on with their lives. Cheats never prosper, remember that.

    While your analogy is certainly creative, there are a million of them that can make it seem alright for people to demand a refund even after cheating in a game, and another million that can make it seem not alright for people to do that.

    The simple fact is this - If you violate the TOS of Evony, and are banned for it, all your rights to recourse of funds are out the window. When you accept them, you are agreeing to a legally binding contract.

    In some endeavors notice isn't enough. You've got beacon tower notice of 1000 waves of 125k phracts coming at you, you're aware of the "impending retribution" But what can you *do* about it? The processes are beyond evony's control.

    Haha funny story, me and my work buddies were talking about how they quit smoking, and im a smoker, so i said "Quitters never win". Which my buddy said, I thought it was "Cheaters never win" To which we debated for about 10 minutes before we agreed the correct saying was...

    As for botters beating their chest re retribution... waste of time. People will still bot, slowly get recognized and banned, and eventually the game will be changed to prevent bots and mean a new cheat has to be devised... rinse and repeat.

    Heck, those who have read it noticed it was deleted by the system within a couple hours after it was sent as they never deleted it themselves. And many of us coming on was wondering what that mail was about because it wasn't there anymore. So, it was a failure on Evony's part for recalling those warning mails if they had sent it out. They should have never recalled any notice about that if they were serious on their warnings and left it for everyone to read. Those that did read the mail when noticed it was gone, many of them got the impression that Evony was no longer going thru on their warnings. It's plain simple. It's like a speed sign on a highway, It's been posted up to limit the speeders, if that gets taken down, people would be going as fast as they could. Any tickets issued to the speeders would have it thrown out of court because there was no speed sign posted.

    What did Evony expect would happen if they recalled all related messages about bot users? Lets say only about 25% of the people actually saw the warning, but what does that say for the other 75%? Almost nobody reads the ToS/ToA anymore these days because it's just so much to read. Most terms have pages and pages of fine prints these days. Who's going to spend an hour or more reading all that for every single thing they come across. Evony has been clearly avoiding the issue when it comes to warning people about this. My past experience with Blizzard's game World of Warcraft and Blizzard has been very clear on their positions and posted warnings. Everyone there knows of such things, but oddly enough, they allow boxing accounts, which many people view that as unfair advantage. However Evony will not make their position clear on these issues because they refuse to keep their warnings posted. So many people don't know what's Evony's position on this and they punish those that get caught anyways. So, it's time for Evony to make their position known if they are taking actions. Keep those warnings posted, and send out system mails for everyone to read and do not recall any messages to avoid miscommunications or misunderstandings.

    Every time you log in on the home page, there is a notice against bots.

    It's peoples fault if they don't read the T&C, Evony has every right to refuse refunds to Bot users.
